Blackjewel, L.L.C. of 1051 Main Street, Milton, WV 25541 is applying to the Virginia Division of Mined Land Repurposing for a Revision of Permit 1302285.
This revision concerns changing part of the permit area to a post mining land use of Industrial – Manufacturing Area. The presently approved land use and acreage is 51.68 acres of hayland/pastureland. The revision proposes land uses and acreages as follows: 5.14 acres of hayland/pastureland and 46.54 acres of Industrial – Manufacturing Area. The revision application also proposes to keep sedimentation structures #001, #002, #003, #004, Basin 6, and Basin 7 as permanent structures after mining permit release.
This Facility is located approximately 3 miles West of the town of Swords Creek, off Virginia Rt. 67, in Russell County, VA located on the 7.5-minute Honaker Quadrangle map at SPC N 3,552634.760 and E 10,479,651.953 (Virginia NAD83 South Feet Coordinates). The Permit covers 51.68 acres.
Drainage and waste water resulting from the permitted operation will be discharged as follows:
Discharge points 003, 004, and 006 discharge into unnamed tributaries into the Clinch River. No new discharge points are being added in this revision. The Post Mining Land Use Map showing the permit area is attached in Section 21.2 of this application. The NPDES discharge locations may be viewed on the Surface Water Hydrology Map in Section 21.2 in this application.
Any person whose interests are or may be adversely affected by the proposed revision, or an Officer, or Head of any Federal, State, or local government agency or authority may within 30 days of (August 12, 2026 submit written comments or objections to the Division of Mined Land Repurposing Program concerning the proposed revision; and may also request, in writing, that the Division hold an Informal Conference concerning the application. A request for an informal conference shall follow the requirements of 4 VAC 25-130-773.13c of the Virginia Coal Surface Mining Reclamation Regulations.
